Boca Raton Mediation Lawyers
A More Cooperative Approach to Divorce
A mediated divorce is an increasingly popular alternative to traditional divorce, which is, by nature, adversarial. It is an informal and family-centered process in which the divorcing parties meet with an impartial mediator who helps them reach agreement about the terms of their divorce. In addition to possibly being more amicable than a traditional divorce, mediated divorce is also less expensive. Mediation is mandatory under Florida law before a divorce case can go to trial.
The Boca Raton divorce mediation lawyers at Feldman & Schneiderman first became involved in the subject when it was being developed, and they have since amassed a great deal of experience with this type of divorce.

How Does it Work?
In a mediated divorce, the two parties and their lawyers meet with a neutral party — ideally, a lawyer who is knowledgeable about divorce law— to discuss and resolve a variety of issues. The mediator meets with the divorcing parties together and separately in order to point out when the demands of one or the other party are unreasonable and to bring about a compromise. After the parties have exchanged required financial documents and the attorneys feel they have sufficient information to advise their clients, the mediator helps explore the strengths and weaknesses of each party’s case and helps them move from advocacy and rigidity to compromise and flexibility. Mediations need not be limited to one day. Sometimes, after mediation, the parties learn that they have some new issues to consider and they return another day for additional mediation. The good news is that 97% of divorce cases in Florida settle without a trial.
The two most common matters of concern regarding divorce mediation are:
- Fear mediation will not work because of the inability of the couple to communicate effectively
- Concern the agreement produced will not be legally binding

Divorce mediation builds on the premise that divorce is not just a legal event, but also an emotional one. It provides a safe context for constructive problem-solving by the divorcing parties and is designed to help develop positive post-divorce family relationships. Research shows that the satisfaction rate for mediated divorce agreements is much, much higher than for agreements imposed by a court.
The key to the success of a mediated divorce is finding a mediator who has both legal knowledge and an understanding of human behavior.
